Welcome to Plusana! These Terms of Service ("Terms") govern your use of the Plusana website, applications, and services (collectively, the "Service") provided by Plusana ("Plusana", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Description of Service

Plusana is a patient engagement platform that allows healthcare practitioners ("Practitioners") to create and send tasks with questions to their patients via WhatsApp to monitor symptoms, side effects, and other health-related data. The Service is intended for professional use by qualified healthcare providers.

2. User Accounts & Responsibilities

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

  • You are a qualified healthcare professional. You represent and warrant that you are licensed and in good standing to provide healthcare services in your jurisdiction.
  • Patient Consent: You are solely responsible for obtaining all necessary consents and authorizations from your patients to collect, use, and store their personal and health information via the Service, including their consent to receive messages on WhatsApp.
  • Compliance with Laws: You agree to use the Service in compliance with all applicable laws, including data privacy and healthcare regulations like HIPAA.

3. HIPAA & Business Associate Agreement

For Practitioners subject to the Health Insurance Portability and Accountability Act (HIPAA), your use of the Service for transmitting Protected Health Information (PHI) is governed by a separate **Business Associate Agreement (BAA)**. You must sign our BAA before you can use the Service to manage patient data. The BAA is a legally binding contract that outlines our respective obligations to protect PHI.

4. Subscriptions and Payment

The Service is offered on a subscription basis. By signing up for a free trial or a paid plan, you agree to our pricing and payment terms.

  • Free Trials: We may offer a free trial period. If you do not cancel before the end of the trial, you will be automatically charged for the subscription plan you selected.
  • Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually). All payments are non-refundable.
  • Cancellation: You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing cycle.

5. Data Ownership and Security

You retain all rights and ownership of the content you create and the patient data you collect ("Your Data"). We do not claim any ownership over Your Data. We implement industry-standard security measures to protect Your Data, as detailed in our Privacy Policy.

6. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, PLUSANA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. IN NO EVENT SHALL PLUSANA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.
